{"id":3950,"date":"2020-05-03T13:15:17","date_gmt":"2020-05-03T13:15:17","guid":{"rendered":"http:\/\/alcafricanradio.com\/?p=3950"},"modified":"2020-05-03T13:15:17","modified_gmt":"2020-05-03T13:15:17","slug":"covid-19-emergency-powers-create-human-rights-challenges","status":"publish","type":"post","link":"https:\/\/alcafricanradio.com\/index.php\/2020\/05\/03\/covid-19-emergency-powers-create-human-rights-challenges\/","title":{"rendered":"\u2018COVID-19 emergency powers create human rights challenges\u2019"},"content":{"rendered":"\n<p><strong>\u2018COVID-19 emergency powers create human rights challenges\u2019<\/strong><\/p>\n\n\n\n<p><strong>May 3, 2020<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"http:\/\/alcafricanradio.com\/wp-content\/uploads\/2020\/05\/UN-SG-Guterres-April-2020-1-1024x683.jpg\" alt=\"\" class=\"wp-image-3956\"\/><figcaption>UN Secretary General Guterres warns against human rights violations under COVID-19 emergency powers.<\/figcaption><\/figure>\n\n\n\n<p style=\"color:#0c0202\" class=\"has-text-color\">WHILE governments around the world moved swiftly to counter the coronavirus, the emergency powers that were handed over to the various security forces are being seen as a threat to human rights.<\/p>\n\n\n\n<p style=\"color:#00070a\" class=\"has-text-color\">UN Secretary-General Ant\u00f3nio Guterres has published a report on the need to make human rights the centre of the response to COVID-19, warning that the pandemic risks becoming a human rights crisis.<\/p>\n\n\n\n<p>\u201cA human crisis that is fast becoming a human rights crisis,\u201d Guterres said in his description of the response.<\/p>\n\n\n\n<p>While acknowledging the need for rapid reaction, he said widespread lockdowns had made the least protected in society \u2013 such as refugees and the disabled \u2013 more vulnerable.<\/p>\n\n\n\n<p>He said that \u201cheavy-handed security responses\u201d risked \u201cundermining the health response\u201d.<\/p>\n\n\n\n<p>The UN SG\u2019s report warned of \u201caggressive cyber-policing and increased online surveillance\u201d during the lockdowns.<\/p>\n\n\n\n<p>Almost 60 countries have closed their borders, making no exceptions for people seeking asylum; there are also increased reports of domestic abuse across the globe.<\/p>\n\n\n\n<p>Steve Cockburn, Amnesty International\u2019s Deputy Director of Global Issues, said: \u201cAnt\u00f3nio Guterres\u2019 report is a timely reminder that human rights need to be at the centre of the response and recovery.<\/p>\n\n\n\n<p>\u201cThis pandemic has wrenched away the distractions that have allowed us to pretend that violations against people who live far away or look different are not our concern.<\/p>\n\n\n\n<p>\u201cIf one person is sick with COVID-19 we are all at risk, and the same is true for human rights.<\/p>\n\n\n\n<p>\u201cA world that protects the rights of a lucky few is unhealthy and unsustainable.\u201d<\/p>\n\n\n\n<p>Amnesty said it was monitoring human rights violations that \u201ctake place in the context of the COVID-19 pandemic, including the right to health, access to information, right to housing, water and sanitation, discrimination, and rights to and at work\u201d.<\/p>\n\n\n\n<p>Last week, Neil Bush, the head of the UK delegation to the Organisation for Security and Cooperation, delivered a joint statement at the virtual OSCE Permanent Council on protecting human rights during the COVID-19 pandemic.<\/p>\n\n\n\n<p>He said there was a risk that some measures taken to halt the spread of the coronavirus had \u201cthe potential to affect all human rights: civil and political, and well as economic, social and cultural\u201d.<\/p>\n\n\n\n<p>Bush went on: \u201cRestrictions on freedom of opinion and expression, peaceful assembly, freedom of movement, and freedom to seek and receive information need to be considered with great care, and with legal safeguards.<\/p>\n\n\n\n<p>\u201cCivil society organisations, human rights defenders and journalists must be able to perform their independent roles, now more than ever.<\/p>\n\n\n\n<p>\u201cIt is vital that any restrictions on human rights are lawful, both as a matter of international human rights law and national law.<\/p>\n\n\n\n<p>\u201cMeasures to address COVID-19 should be targeted, time-limited, and subject to regular review to ensure they remain necessary as a response to the pandemic,\u201d Bush added.<\/p>\n\n\n\n<p>\u201cStates must not use COVID-19 as a cover for repressive action, for example, the silencing of human rights defenders or journalists.\u201d<\/p>\n\n\n\n<p>Last month, the Commonwealth Lawyers Association (CLA) cautioned Commonwealth governments not to misuse the emergency powers that they had enacted as part of their efforts to combat the deadly coronavirus.<\/p>\n\n\n\n<p>The CLA said in a statement: \u201cGiving the police emergency powers, for example to impose fines and to be able to order people away from open spaces, requires those powers to be applied with proportionality.<\/p>\n\n\n\n<p>\u201cEmergency legislation must address the emergency.<\/p>\n\n\n\n<p>\u201cSuch emergency powers should not be seen as an opportunity to pass laws which simply shore up a government or political party.&nbsp;<\/p>\n\n\n\n<p>\u201cThe Rule of Law provides for scrutiny by Parliament of the acts of the Executive; allows informed criticism and debate without fear or stifling; allows for independence of the Judiciary and the legal profession.<\/p>\n\n\n\n<p>\u201cThe Executive must operate knowing it will be held to account,\u201d the CLA added.<\/p>\n\n\n\n<p>They cautioned: \u201cThe Executive in any parliamentary democracy must be scrutinised by Parliament.&nbsp;<\/p>\n\n\n\n<p>\u201cThe emergency legislation passed must not carry on when the emergency has passed.<\/p>\n\n\n\n<p>\u201cThese powers have a season and are unconstitutional in normal times.<\/p>\n\n\n\n<p>\u201cThe politicians who find themselves as part of an Executive at this time have responsibilities and are accountable.\u201d<\/p>\n\n\n\n<p>The lawyers urged Commonwealth governments to \u201cact proportionately;
